Terms of Service

1. Agreement to terms

These Terms constitute a legally binding agreement between you ("you", "Customer") and Ghost Con Oy ("Hero Monday", "we", "us") governing your access to and use of the Hero Monday platform, website, and any related services (the "Services").

By accessing or using the Services, you confirm that you are at least 18 years old, that you have the authority to bind any company or organization on whose behalf you act, and that you agree to be bound by these Terms. If you do not agree, you may not use the Services.

2. Your account

To use most features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at security@heromonday.fi if you suspect any unauthorized use of your account. We are not liable for losses caused by unauthorized access resulting from your failure to safeguard your credentials.

3. Acceptable use

You agree not to use the Services to:

• •Violate any applicable law, regulation, or third-party right.
• •Infringe the intellectual property, privacy, or other rights of any person.
• •Send unsolicited or unauthorized advertising, spam, or phishing messages.
• •Upload or transmit viruses, malware, or any other malicious code.
• •Interfere with, disrupt, or overload the Services or their infrastructure.
• •Attempt to gain unauthorized access to the Services, other accounts, or systems.
• •Reverse engineer, decompile, or disassemble any part of the Services.
• •Use the Services to store or process data in violation of applicable data protection laws.

4. Your data and responsibilities

You retain all rights to the data you upload to or create within the Services. You are responsible for the accuracy, legality, and appropriateness of the data you store, and for ensuring you have the necessary rights and consents to process any personal data through the Services in compliance with applicable data protection laws, including the GDPR.

Hero Monday processes customer data as a data processor on your behalf, as described in our Privacy Policy and any applicable Data Processing Agreement. You are the data controller for the personal data you store in your account.

5. Subscriptions and billing

Paid plans are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). By subscribing, you authorize us to charge the applicable fees to your payment method until you cancel.

You can upgrade, downgrade, or cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period, and no further charges are made. Fees paid are non-refundable except where required by law.

We may change our fees upon reasonable notice. Price changes take effect at the start of your next billing cycle after notice is given.

6. Trial accounts

We may offer free trial accounts for a limited period. Trial accounts provide access to certain features without charge. At the end of the trial, the account is automatically converted to a paid subscription unless you cancel before the trial ends. We will notify you before the trial expires.

7. Intellectual property

The Services, including their design, software, text, graphics, and branding, are owned by Ghost Con Oy and are protected by Finnish and international intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or brand assets without prior written consent.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes during the term of your subscription, subject to these Terms.

8. Third-party services

The Services may integrate with third-party applications and services (such as Google Calendar, Outlook, and email providers). Your use of these integrations is subject to the terms and privacy policies of those third parties. Hero Monday is not responsible for the practices or content of third-party services, and you connect them at your own discretion.

9. Service availability

We strive to maintain high availability but do not guarantee that the Services will be uninterrupted, error-free, or secure at all times. We may modify, suspend, or discontinue any feature of the Services at any time, with reasonable notice where feasible. Scheduled maintenance may cause temporary unavailability.

10. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will meet your requirements, that they will operate without interruption, or that all errors will be corrected.

11. Limitation of liability

To the maximum extent permitted by law, Ghost Con Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to the Services, whether based on contract, tort, or any other legal theory.

Our total aggregate liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim. This limitation does not apply to liability that cannot be limited under applicable law, such as liability for gross negligence or willful misconduct.

12. Indemnification

You agree to indemnify and hold harmless Ghost Con Oy and its affiliates, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

13. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your access to the Services immediately, without notice, if you breach these Terms or if we reasonably believe your use poses a risk to the Services or others.

Upon termination, your right to use the Services ends. You may export your data before termination; after a reasonable grace period, we may delete your data in accordance with our Privacy Policy and retention policy.

14. Governing law and disputes

These Terms are governed by the laws of Finland, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services shall be resolved in the courts of Helsinki, Finland, unless we agree in writing to resolve the dispute through arbitration or another forum.

15. Changes to these terms

We may update these Terms from time to time. We will notify you of material changes through the platform or by email and update the "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
